
A secondary suite is defined as an additional dwelling unit attached to the principal dwelling unit and:
(a) having a total floor area of not more than 90 square metres in area;
(b) having a floor area less than 40% of the habitable floor space of the building;
(c) having not more than two bedrooms;
(d) located within a building of residential occupancy containing only one other
dwelling unit; and
(e) located in and part of a building which is a single real estate entity and otherwise a single family dwelling.
A “legal” suite meets the requirements of the zoning bylaw as well as the building code.
